Care and protection in NSW – what’s new?

Pay increases on 1 July 2023 – are you affected?
On 1 July 2023 a number of employment law changes commenced, including an increase to the National Minimum Wage.

The Whys and Woes of Making a Will - NSW Trustee and Guardian June 2023
Your Will is an important legal document outlining your wishes for when you pass away. It details:
who you want to receive your assets
who you want to receive specific personal and heirloom items
any religious or cultural arrangements for your funeral
who you want as a legal guardian for any children under 18 years

Strata for Starters - Marrickville LC Strata Collective Sales and Advocacy Service
Strata Collective Sales and Advocacy Service
This episode talks about being a tenant in a strata managed property and being an owner living in a strata managed property.
Marrickville Legal Centre offers free legal advice and assistance to the community of the inner-west, south-west, southern suburbs of Sydney, and beyond. There are 1.5 million people living in our key catchment: that’s 30 per cent of Sydney’s total population.
They acknowledge the Gadigal, Wangal, Guringal, Wallumedegai and Cammeraygal people of the Eora Nation as the first peoples of our region.
In 1979, a group of law students identified a gap in accessible legal services in the inner west of Sydney. Together they established a free legal advice service in a small office in Marrickville Town Hall. The service was staffed on a voluntary basis and specifically targeted the local migrant community. The community response was overwhelming and so marked the creation of NSW’s second community legal centre, two years after Redfern Legal Centre.

Spotlight On Australia’s Animal Defenders Office
The Animal Defenders Office (ADO) is a national non-profit community legal centre that specialises in animal law.
The ADO was incorporated in the Australian Capital Territory in late 2013. In 2017 we were formally recognised and accredited by the Australian National Association of Community Legal Centres as part of the National Accreditation Scheme ("NAS") Phase 2. On 11 May 2022 we were formally accredited by CLCs Australia Inc under NAS Phase 3.
As a community legal centre that focuses on helping animals and animal advocates, the ADO:
Offers free advice and representation for individuals and groups that want to take action for animals; and
Produces information to raise community awareness about animal protection; and
Works to advance animal interests through law reform.
We are a national community legal centre in that we aim to assist individuals and groups from around Australia with matters affecting animals and their (human) defenders.
We are run by volunteers and receive no ongoing government funding.

Spotlight On The Welfare Rights Centre
The Welfare Rights Centre opened its doors in 1983 as part of the community legal centre movement in Australia that began in response to scarcity of affordable legal assistance available to marginalised members of society. Originally co-located with Redfern Legal Centre, the Centre opened its own premises in 1985. Since then it has experienced changes in location, staff, funding sources, law and policy. Throughout these changes, the Welfare Rights Centre has remained the lead service agency in NSW for social security law and policy.
The Welfare Rights Centre is a community legal centre specialising in social security law and family assistance law and its administration by Centrelink.
They provide free legal information, advice and representation to thousands of NSW residents every year who are adversely affected by Centrelink decisions. The Centre also provides education to improve knowledge and understanding about social security law in the community. They use the knowledge and experience they gain through their casework to advocate for reforms to the law and policy that would make the Australian social security system fairer for everyone.
They can advise people about their social security rights, entitlements and obligations and assist people through the social security review and appeals system, including Centrelink internal review and the Administrative Appeals Tribunal. They provide all initial advice by phone.

Spotlight On The Shopfront Youth Legal Service
The Shopfront Youth Legal Centre provides free legal assistance for homeless and disadvantaged young people aged 25 and under. We are based in inner Sydney but can also help young people outside this area.
The Shopfront was established in 1993 and is operated jointly by Herbert Smith Freehills, Mission Australia and The Salvation Army. The legal services are provided by Herbert Smith Freehills on a pro bono basis and our case work service is provided by Mission Australia.
We provide legal representation and advice to homeless and disadvantaged young people aged 25 and under.
We also have a case work service to provide social support and referrals to a range of other services.

New Year. No Debt: Budgeting, Debt and Credit Reports
The Financial Counsellor role sits within the Consumer Law Team, and the Financial Counsellor is available to receive referrals from the Civil Law division
A Financial Counsellor can:
Assess a client’s financial situation and advise on possible solutions.
Make financial hardship applications, including requesting debt waivers.
Provide advice for clients who are struggling to pay bills, meet basic financial needs and prioritise creditors.
Help clients to negotiate with creditors, such as banks, water and energy suppliers, telco’s, government agencies, landlords, debt collectors and others.
Refer clients to other services they may need such as legal, accommodation, or crisis services.
Provide training to solicitors and community on financial hardship issues and how to complete a statement of financial position.
Our Financial Counsellors cannot give grants or arrange relief.
All Financial Counsellors at Legal Aid work within our Allied Professional Framework that states that “all Allied Professional Services are tied to the legal matter in which LA NSW is engaged”. Lawyers working with allied professionals result in an improved experience and better outcomes for our clients. Only in exceptional circumstances will the Financial Counsellor be able to work with clients who do not have an ongoing legal matter.

This episode is being released on the International Transgender day of Visibility, Friday March 31st 2023 to celebrate and support Trans and Gender Diverse people in our lives and communities.
The Inner City Legal Centre, in partnership with Dentons, offer the Trans and Gender Diverse Legal Service for transgender and gender diverse people experiencing legal problems. The service runs a fortnightly appointment-based legal clinic on a Monday, with appointments taking place over the phone.

Spotlight On Immigration Rights and Advice Centre (IARC)
The Immigration Advice and Rights Centre (IARC) is a specialist, not-for-profit community legal centre (CLC) with over 35 years’ experience in migration law and policy.
IARC’s vision is for a fair and just immigration system for everyone, regardless of means. IARC assists migrants experiencing vulnerability in NSW by providing free legal information, advice, and casework services.
Our clients are financially disadvantaged, come from culturally and linguistically diverse backgrounds, and often speak little or no English. Many experience multiple layers of disadvantage including homelessness, low education levels, and disability. They have often experienced torture or trauma. Almost half of our clients have experienced, or are at risk of, family violence.
IARC also provides community legal education (CLE) services, undertakes law reform and policy activities, and collaborates with other organisations in the legal and social justice/human rights sector on individual matters and systemic issues.

Spotlight On the Homeless Persons Legal Service
The Homeless Persons’ Legal Service (HPLS) provides people who are homeless or at risk of homelessness with practical legal assistance. Informed by our casework and consumer feedback, we also address causes of homelessness through strategic engagement and policy advocacy with government and service providers.
They have recently launched the Women’s Homelessness Prevention Service (WHPS), which aims to help women at risk of homelessness, particularly women experiencing domestic and family violence.

This is Part 1 of a new podcast series exploring homelessness in Australia and the legal issues people experience when they are homeless or at risk of homelessness. During this series we will be speaking to people from different services providing support and legal advice to those experiencing homelessness.

Spotlight On the Sexual Harassment Legal Service of the Kingsford Legal Centre
Kingsford Legal Centre is part of the UNSW Sydney Faculty of Law & Justice and provides a number of clinical legal education programs to its students. KLC's lawyers, volunteers and students help over 1,500 local community members each year with problems such as domestic violence, discrimination, housing, employment, criminal law, credit and debt, fines and victim’s compensation.
The Sexual Harassment Legal Service works across a range of areas, including:
Legal advice, assistance and representation to people who have or are experiencing sexual harassment;
Community legal education aimed at preventing sexual harassment and empowering people to speak up when it happens. This education is focused on a wide range of audiences, from high school and university students to community legal centres, pro bono lawyers and community workers;
Law reform work to advocate for better legal protections for people who experience sexual harassment. This work aims to improve how the law and institutions deal with sexual harassment and draws on the direct experience of our clients;

Overspending at Christmas can be the worst start to new year for a lot of people. In this episode we speak with two of Legal Aid’s Financial Counselors about some of the spending traps people can fall into at Christmas and give some information about tools and services available for people to gain control over their spending.

Spotlight On HIV AIDS Legal Centre (HALC)
The HIV AIDS Legal Centre (HALC) is a not-for-profit, specialist community legal centre, and the only one of its kind in Australia.
They tackle the severe stigma and discrimination associated with HIV by providing specialist services to vulnerable people living with HIV and viral Hepatitis in Australia. They provide free and comprehensive legal assistance (within operational guidelines) to people in NSW with HIV or Hepatitis-related legal matters.
HALC also provides volunteer placements for law students, particularly those undertaking their practical legal training (PLT) requirement prior to admission as a legal practitioner.

Spotlight On Witness Assistance Service
The Witness Assistance Service (WAS) provides support and information for vulnerable victims and witnesses involved in criminal cases. The WAS is part of the ODPP (Office of the Director of Public Prosecutions) and WAS officers are available to provide services through each of the ODPP offices.
Aboriginal and Torres Strait Islander WAS Officers can provide culturally appropriate support across the State to witnesses who are Aboriginal or Torres Strait Islander.
WAS officers are social workers, psychologists or counsellors who understand both trauma and how the criminal justice system works.

Spotlight On Police Accountability Practice
This episode introduces the Redfern Legal Centre Police Accountability Practice. They are the only specialised police accountability practice in NSW.
They can advise people on issues or incidents around:

This is Part 1 of the eighth episode in our series called “Renting Matters”, which explores all aspects of tenancy and other living arrangements in NSW. This series is a joint project between the Tenants’ Union of New South Wales (“TU”) and Legal Aid NSW.
The final episode of this series is in 2 parts. In part 1 Bridget from the Community Legal Education Branch speaks to two international students about the challenges they faced with their tenancies during the first phase of the Covid19 pandemic and other challenges they have faced in the rental housing market. Bridget speaks to Sanjaya and Chaitra during this episode.
