Send us a textHi there In this week’s podcast episode, we continue our series, looking in detail at the different types of paid and unpaid leave that you may be entitled to receive at work.  In episode 36 of the podcast, we looked at Unpaid Parental Leave.  In this week’s episode of the podcast, we’re going to look at Shared Parental Leave, which is a different type of leave altogether, and is form of paid leave that is in place for parents who want to take time off after their baby is born or after your adopted child comes to live with you.  The leave must be taken in the first year of your child’s life or after your adopted child is placed with you. If you or your partner apply for Shared Parental Leave you may also be able to claim Shared Parental Pay and if you qualify for both elements, that’s the leave and the pay - you and your partner could share up to 50 weeks of leave and up to 37 weeks of pay between you. Send us a textHi there I hope you are having a positive employment rights week.  This week we continue our series… looking in detail at the different types of paid and unpaid leave that you may be entitled to receive at work.  In this week’s episode …we take a look at the top seven things you need to know about  … if you want to take emergency time off to care for family and dependents… more commonly known as dependent leave. Dependent leave is time off from work that you can legally take, to deal with an emergency involving a dependent.       A dependant could be a child, grandchild, spouse, a parent or anyone who would normally or reasonably rely on you for assistance. There is no legal amount of time off you can take, but your employer is expected to allow you enough time off to deal with the emergency. Legally, your employer does not have to pay you when you are off but your contract of employment should tell you how your employer’s dependent leave process works. In this week’s episode, we look at the seven key pieces of employment rights information you need to know about dependent leave. You may or may not know that adoption leave is treated pretty much the same as maternity leave when it comes to the leave you get and the pay you are entitled too.  However, where we need to pay close attention, is in the arrangements you need to follow to the letter, to make sure you don’t lose your right to claim your adoption leave and your adoption pay. It is those differences that we take a deep-dive into, in this week’s episode. This week… as we start to move back into employment proper, we’re going to look at the ten different types of time off from work that you need to know about. Time off from work is one of the most contested areas of a workers working life, and the reasons for this are because a lot of employers and most workers are not fully aware of the different types of leave, nor the entitlement criteria that surrounds that leave - and because of this, workers lose out on legal leave entitlement and paid leave entitlement, to the tune of £9 billion per year. This week we take a brief look at the different types of entitlement.  In the next few podcasts, we will then look at each of these areas in more detail. This week, we continue our discussion about unethical behaviour at work – only this week, we look at the far more serious topic of whistleblowing.  Whistleblowing, or to use its legal name, public interest disclosure, is far more serious than unethical conduct - why - because there is a whole law that surrounds the protection of workers who make disclosures about their bosses or companies because they believe that if they stay silent, people could be harmed or could even die from the illegal behaviour of their bosses or companies. In this episode, we look at the four different types of disclosures you can make and we also look at what you can do if you make a disclosure and your employer begins to treat you in a negative way, because you made that disclosure. The key here is that although attempts may be made to silence you, you need to decide whether the decision you make to expose wrongdoing, is the right one. Send us a textHi Everyone In this week’s podcast, I make a quick reference to the new guidance that has just been issued by central government …about calculating statutory holiday pay.  The regulations were actually updated on 06/04/2020.  Whereas calculations for holiday pay, for people on fixed hours and rates of pay, has always been relatively standard, for people who work irregular hours or who are on Zero Hours Contracts, this has not been the case.  There have been long standing disputes about how holiday pay is worked out for this latter group of workers, and it’s this particular dispute, which the new regulations were created to address. I was being investigated for something that happened at work and then I was being picked on by my boss, we had an argument and I walked out because I was tired of being bullied by people at work who keep telling lies about me to the boss so I will be sacked.  I spoke to my boss about this three months ago, but instead of doing something about it he just lets them make more allegations against me and keeps on investigating me.  It’s never-ending.  Is there anything I can do about this because I feel I have lost my job through no fault of my own?” So, this week we focus on answering this question in terms of the steps we advised the worker to take. Send us a textHi everyone I hope you are doing okay, as we enter the 12th week of lockdown.    This week, I’ve been asked to say something about challenging racism at work, in light of what is happening in the world following the death of George Floyd, which is being described as a hate crime and an act of murder. We have been contacted by a number of Black workers who claim they are suffering racism and racial harassment at work. For Black workers facing racial hostility and aggression at work, simply because they are Black workers, it is important to know that this type of conduct towards you is illegal, both in terms of criminal law in the UK and in terms of employment law in the UK.  And in this week’s podcast, I talk about what you can do to challenge this treatment. As employers scrabble to get everyone back to work, I want to talk about pregnancy-related employment rights, because … well… I’ve had a number of queries about whether the rights of women would change if women are pregnant and are now returning back to work after lockdown. The government have been pretty quiet this week, in relation to employment rights and covid-19 news.  Not much has come out at all since our podcast last week, but you can bet that there is much churning going on in government, when the question of how to open up society and get people back to work in a safe way, is discussed.  One good thing that has come up this week, is the recommendation that employment tribunals extend their deadlines for submitting claims rom the current three months to six months. In this weeks podcast episode, I explore this recommendation in detail looking at the implications for the current arrangements as a way to highlight why and extension in tribunal submission timelines, would really benefit workers – with benefits badly needed as a result of the impact of coronavirus working conditions. Send us a textHey there I hope your doing well and managing to stay safe, in what could well be the sixth week of working from home for some and several weeks into lockdown for most people. I wanted to touch on a question that came up in a conversation I was having with someone making an enquiry about their employment rights.  The question was - whether his employer would find out that he had received a police fine for breaking lockdown restrictions.   And, whilst my answer to that question was that I didn’t know, it did raise other points of concern for me because even though we are all on lockdown and we haven’t seen our workplaces for several weeks - if we are still employed - then we are still bound by our employer’s code of conduct. So this week, I want to talk about problems that could arise when you mix conduct at work with being on lockdown. Things may be tough whilst you’re on lockdown.  But if you’re still tied to your employer, and therefore you need to be aware of your conduct both during and after working hours, to be sure you don’t fall foul of breaching behaviour policies at work.
