When You Get Sacked But Your Dismissal is Still Unfair – Here’s What An Employment Tribunal Will Do!
Send us a textHi thereThis week, we are completing our look at procedurally unfair dismissals, to look at the other side of the dismissal, where the conduct of your employer might have been procedurally wrong, making your dismissal unfair. But, where the tribunal still thinks you have some responsibility for your own dismissal, and you should be held accountable for that responsibility.This is called contributory fault and the tribunal will be looking at whether you contributed to your own dismissal, which led to your unfair dismissal. In this episode, we go through the definition of ‘contributory fault’ and we look at the original legal precedent case, that put ‘contributory fault’ onto the statute books. Unfair Dismissals and the ‘Two Years’ Service’ Rule. Don't Accept Someone Else's Version of Your Work History!

Having just spent the last two episodes looking at the impact of the new covid law on your employment rights, this week, we get back to looking at your rights around unfair dismissals. It’s important that we do this because there are bound to be dismissals that occur because of the new covid law, which some employees will feel, are unfair dismissals. So, knowing some of the steps you can take to at least begin to ask questions can be a helpful route for you. So, in this podcast, the first question we look at, is the question of understanding the importance of your length of service, as a gateway to challenging unfair dismissals in an Employment Tribunal. This week we look at one of the largest ever employment tribunal discrimination payouts, which was awarded against a company called Kellog, Brown & Root, for dismissing a senior employee who had mental health problems. In this episode, we look at the conduct issues the employer put forward for the decision to dismiss the employee; and, we also look at the mental health issues put forward by the employee, as evidence that the employer had selected him for dismissal due to matters related to his behaviour, which were completely linked to his disability. The hourly rate for workers for the National Living Wage and the National Minimum Wage, are set in law, so it helps for you to know what you are entitled to, and what you can do, if you are being underpaid. Is the ‘Bradford Factor’ for Managing Sick Leave Coming to a Workplace Near You!

This week, we’re looking at a sickness monitoring system called the Bradford Factor or the Bradford Formula, which is a system used by some companies to monitor levels of sick leave, but also to monitor the impact or disruption of short, frequent and unplanned sick leave on a company’s business. The aim is to show that shorter bouts of sick leave by employees, has much higher disruption levels than people taking longer periods of sick leave away from work. The formula for working out your attendance score is: Number of sickness spells away from work x the same number (e.g. 2 separate spells of sickness from work would be written as 2x2) The total number of days of sick is then multiplied by the sickness spell number (e.g. 7 days of sick leave across the 2 spells, would be written as 2 x 2 x 7) We hope you find the formula helpful. This week we conclude the series looking at victimisation at work and how you will know if you have been a victim of this. Victimisation unlike bullying is covered by law under the Equality Act 2010 and a definition of victimisation is when you are treated badly because you complain about discrimination or you help someone who has been discriminated against.
