Pubs have witnessed a remarkable comeback post-lockdown with the public viewing the sector with a renewed sense of importance, although challenges undoubtedly lie ahead, according to Fleurets director and head of national agency James Davies. Fleurets currently leads the Radius On Demand Rankings for the UK’s hotel and leisure sector, with almost 300,000 sq ft of space transacted this year. Davies believes pubs have enjoyed a honeymoon period in the post-lockdown period, with many new units opening up in what were traditional retail spaces. However, he also believes the sector needs help with VAT rates and with the ability to hire overseas workers if it is to overcome the recessionary storm clouds currently gathering.

A big first day at CREtech NYC as thousands from around the globe made their way to Pier 36 on the Hudson River to talk tech, climate, investment and the big issues facing the industry. Bristol’s electorate has spoken: the role of city mayor will be dropped when Marvin Rees finishes his term of office in 2024. "Young people are taking on incrementally bigger and bigger roles in this space. They are taking risks, they are getting the leadership team on board and they are delivering great stuff. I think it's working." Jess Harrold is joined by editor Samantha McClary and senior writer Piers Wehner to reflect on the passing of Queen Elizabeth II. In addition, they consider how King Charles III - who has long been known for airing his views on the built environment, and was ahead of his time on the importance of environmental awareness and sustainability - might continue to have an influence on real estate in his new role.

In episode five of In on the Act, Jess Harrold is joined by Paul Letman and Cecily Crampin, of Falcon Chambers, to discuss the Building Safety Act 2022, which was was given royal assent in April. Letman and Crampin address the key provisions of the Act, conceived in response to the Grenfell Tower tragedy and the resulting debate on remediating defective cladding, including the greater protections it provides for leaseholders, increased powers to support the making of building liability orders and the establishment of new regulatory bodies.  

Covid led many to rethink their careers and follow through on aspirations to open shops and this has helped the retail sector bounce back with a vengeance post-lockdown but it now braces itself for a bruising winter, according to Creative Retail director Scott Robertson. Creative Retail, which is Birmingham-based but has an increasingly national presence, sits in fifth place on the 2022 Radius On-Demand Rankings for retail disposals for the whole of the UK. It has let or sold 164,829 sq ft so far this year. Robertson says the sector faces a period of unprecedented economic turbulence and predicts more casualties to come. However, with the right support from both national and local government he believes bricks and mortar retail has a bright future.

Jess Harrold is joined by Guy Fetherstonhaugh QC, of Falcon Chambers, to discuss the eagerly awaited Court of Appeal decision in the combined appeals in Bank of New York Mellon (International) Ltd v Cine-UK Ltd; London Trocadero (2015) LLP v Picturehouse Cinemas Ltd and others [2022] EWCA Civ 1021; [2022] PLSCS 125 - cases both arising out of rent arrears accrued during lockdown periods imposed as a result of the Covid-19 pandemic. Fetherstonhaugh outlines the parties involved in the appeals, including two connected cinema tenants, and how those tenants saw their defences to actions for unpaid rent rejected at first instance. He explains how the arguments were presented in the Court of Appeal, and why it dismissed the tenants' appeals. In addition, Fetherstonhaugh shares his thoughts on where this leaves any tenants who are yet to resolve pandemic rent arrears disputes with their landlords, and whether this might lead to a late rush to use the government's so far under-utilised arbitration scheme.
